Chief justice’s husband to go to trial on “interference” charge

Dennis Drake is the husband of Iowa Supreme Court Justice Marsha Ternus.  A deputy went to the Drake/Ternus property this summer to investigate a complaint about noise from a bonfire/party.  The deputy says he discovered a handful of 19-year-olds there, drinking. Drake was charged with interference with official acts for allegedly failing to follow the deputy’s instructions that night.  Seven of the kids at the bonfire were charged with underage drinking.  Five of the cases have been dismissed. 

Drake’s lawyer asked that the charge against Drake be dismissed.  The judge said no.  A trial date has been set.  Read Eby’s story for more details.
